Terms of service
Welcome to Staffer. These Terms of Service (“Terms”) govern your access to and use of the Staffer platform, website, and services (collectively, the “Service”) provided by Staffer.com AS (“Staffer”, “we”, “us”, or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Please read these Terms carefully. If you do not agree to these Terms, you may not use the Service.
1. Definitions
- “Employer” means any company, organization, or individual that uses the Service to post jobs, source candidates, conduct interviews, or manage recruitment processes.
- “Candidate” means any individual whose personal or professional information is processed through the Service, whether sourced by Staffer or applying directly.
- “User” means any Employer or Candidate who accesses or uses the Service.
- “Content” means any data, text, files, information, job postings, candidate profiles, or other materials uploaded, submitted, or generated through the Service.
- “AI Features” means automated tools including candidate sourcing, matching, and scoring.
2. The Service
2.1 Platform Overview
Staffer provides an AI-powered recruitment platform that enables Employers to source and assess Candidates. The Service includes:
- Candidate sourcing from licensed third-party data providers and public sources
- AI-powered candidate matching and scoring
- A conversational AI assistant that supports briefing, search, and shortlist review
Additional capabilities may be released over time. Where these Terms describe a feature that has not yet shipped, the related obligations apply only once the feature becomes generally available.
2.2 Service Availability
We will use commercially reasonable efforts to make the Service available. However, we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
3. Account Registration and Security
3.1 Employer Accounts
Employers must register for an account to access the Service. When registering, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your login credentials confidential
- Accept responsibility for all activities under your account
3.2 Workspaces and Multiple Users
Employer accounts may include workspaces that support multiple users with configurable access settings. The account owner is responsible for managing user permissions and ensuring all users comply with these Terms.
3.3 Candidate Accounts
Candidates may create accounts to apply for jobs, participate in interviews, manage their profiles, and communicate with Employers through the platform.
4. Fees and Payment
4.1 Token-based pricing
The Service is billed on a usage basis. Employers purchase tokens in advance, and tokens are consumed as the Service is used. The current price per token, the actions that consume tokens, and any volume tiers are published on our pricing page (staffer.com/pricing) and incorporated into these Terms by reference.
4.2 Non-refundable consumption
Tokens that have already been consumed by the Service are non-refundable, regardless of the outcome of the underlying recruitment activity. Pricing changes apply only to tokens purchased after the change takes effect.
4.3 Withdrawals of unused balance
Employers may request a refund of their unused (unconsumed) token balance:
- Free of charge when the request accompanies deletion of the Employer account, or
- Subject to a reasonable processing fee for extraordinary withdrawals while the account remains active. The current processing fee is disclosed at the time of the withdrawal request.
Refunds are issued to the original payment method where possible and may take up to 30 days to settle, depending on the payment processor.
4.4 Taxes
All fees are exclusive of VAT, sales, use, withholding, and similar taxes, which the Employer is responsible for paying where applicable.
5. Cancellation and Termination
5.1 Employer Cancellation
Because the Service is billed on a usage basis (see §4), there is no subscription to cancel. Employers may delete their account at any time from account settings. On account deletion:
- The remaining (unconsumed) token balance is refunded in full,
- Tokens already consumed remain non-refundable per §4.2, and
- Data is handled in accordance with §5.2 and our Privacy Policy.
5.2 Effect of Termination
Upon termination of an Employer account:
- Access to the Service will be revoked
- Employer-uploaded Content (job postings, company information) may be deleted upon request
- Candidate data associated with the Employer’s recruitment processes will be retained in Staffer’s general candidate pool, subject to Candidate rights under our Privacy Policy
- Staffer will maintain the relationship with Candidates and may contact them regarding their data preferences
5.3 Termination by Staffer
We may suspend or terminate your access to the Service at any time if you breach these Terms, engage in prohibited conduct, or if required by law. We will provide reasonable notice where practicable.
6. Acceptable Use
6.1 Permitted Use
You may use the Service only for lawful recruitment purposes in accordance with these Terms.
6.2 Prohibited Conduct
You agree not to:
- Use the Service for any purpose other than legitimate recruitment activities
- Engage in discriminatory hiring practices based on race, gender, age, religion, national origin, disability, sexual orientation, or any other protected characteristic
- Violate any applicable laws, regulations, or third-party rights
- Scrape, harvest, or collect data from the Service through automated means without authorization
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service or servers
- Upload malicious code, viruses, or harmful content
- Impersonate any person or entity
- Use the Service to send spam or unsolicited communications
- Reverse engineer, decompile, or disassemble any part of the Service
- Resell, sublicense, or redistribute the Service without authorization
- Use Candidate data for purposes unrelated to the specific recruitment process
7. Intellectual Property
7.1 Staffer’s Rights
Staffer and its licensors retain all rights, title, and interest in and to the Service, including all software, algorithms, designs, documentation, and other intellectual property. These Terms do not grant you any rights to use Staffer’s trademarks, logos, or branding.
7.2 Employer Content
Employers retain all intellectual property rights in the Content they upload to the Service, including job descriptions, company information, and recruitment materials. By uploading Content, you grant Staffer a non-exclusive, worldwide license to use, store, display, and process such Content solely to provide and improve the Service.
7.3 Candidate Data
Candidate data processed through the Service is governed by our Privacy Policy. Staffer may retain and use Candidate data in accordance with applicable law and our legitimate interests in providing recruitment services.
8. AI Features and Automated Processing
8.1 AI-Assisted Recruitment
The Service uses artificial intelligence to assist with candidate sourcing, matching, and scoring. You acknowledge that:
- AI-generated insights are intended to assist, not replace, human decision-making
- Employers are responsible for making final hiring decisions
- Staffer does not make fully automated decisions with legal or similarly significant effects
8.2 Fairness and Compliance
Employers are responsible for ensuring their use of AI Features complies with applicable employment and anti-discrimination laws. Staffer monitors AI systems for fairness but does not guarantee specific outcomes.
9. Data Protection and Privacy
Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
Employers using the Service to process Candidate data may be required to enter into a Data Processing Agreement with Staffer.
10. Third-Party Services
The Service integrates with third-party services, including:
- Authentication providers (Microsoft, Google, LinkedIn) for account sign-up and login
- Candidate data providers for sourcing professional profiles into the talent graph
- Payment processors (Stripe) for billing and token purchases
Your use of third-party services may be subject to their own terms and privacy policies. Staffer is not responsible for third-party services except as expressly stated in these Terms.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
STAFFER DOES NOT WARRANT THAT:
- The Service will meet your specific requirements
- The Service will be uninterrupted, timely, secure, or error-free
- Any information obtained through the Service will be accurate or reliable
- AI-generated insights or recommendations will be suitable for your purposes
Candidate data sourced from third-party providers is provided as-is. Staffer does not guarantee the accuracy, completeness, or currency of such data.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- STAFFER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL
- STAFFER’S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO STAFFER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM
These limitations apply regardless of the theory of liability (contract, tort, or otherwise) and even if Staffer has been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Staffer and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law or third-party rights
- Your Content or recruitment practices
- Any hiring decisions you make based on information obtained through the Service
14. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 30 days before the changes take effect.
Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
15. Governing Law and Disputes
These Terms are governed by the laws of Norway, without regard to conflict of law principles.
Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively by the courts of Oslo, Norway. You consent to the personal jurisdiction of such courts.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy and any applicable Data Processing Agreement, constitute the entire agreement between you and Staffer regarding the Service.
16.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
16.3 Waiver
Staffer’s failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
16.4 Assignment
You may not assign or transfer these Terms without Staffer’s prior written consent. Staffer may assign these Terms without restriction.
16.5 Notices
Notices to Staffer should be sent to privacy@staffer.com. We will send notices to the email address associated with your account.
